Privacy notice
Introduction
This Privacy Notice sets out the information we collect from you, what we do with your information, what we do to keep it secure, as well as the rights and choices you have over your personal information.
“We” refers to 121 Tax Claims Ltd, a private company incorporated in England and Wales (company number 14809007) whose registered office is located at 128 City Road, London, EC1V 2NX. We are registered as data controllers with the Information Commissioner’s Office (ICO) with registration number ZB663591. For the purposes of the General Data Protection Regulation (‘GDPR’), we are the controller in relation to your data.
1. The information we collect
We only collect personal information that we know we will genuinely use. All information is collected in accordance with the Data Protection Legislation.
The type of personal information that we will collect about you, and you voluntarily provide to us, may include some or all of the following:
- Name
- Address
- Date of birth
- National insurance number
- Telephone number
- Email address
- Identification documents
- Device identification and location information
- Any other information required to provide our service
We collect this information when:
- You register your details on our website or through a third party
- Contact us by telephone, email, post or live chat
- You use devices to access our website (for example, mobile phones and laptops)
- A third party, such as HMRC, provides information in response to your claim
- We verify your identity through electronic verification providers
2. How we use your information
We collect, store and use your information for the following purposes:
- Personal information, to identify you and verify your identity in compliance with Anti-Money Laundering Regulations;
- Financial information, to assess your eligibility to claim a tax refund through our service and to prepare the relevant claim form for submission to HMRC;
- Contact details, to respond to your enquiry, reply to any questions, suggestions, issues or complaints you have contacted us about unless you have opted-out;
- Marketing preferences, to make our products, services and promotions available to you, unless you have opted-out;
- Bank details, to remit your tax refund to you (after deduction of our fees) following receipt from HMRC;
- Device information, to obtain information about your visits to and use of our website, including your IP address and geographical location.
3. Who we may share your information with
We may share your personal data with other organisations in the following circumstances:
- To progress your claim by submitting your information with HMRC;
- If the law or a public authority says we must share the personal data;
- To verify your identity through electronic verification providers;
- When we engage third parties to deal with certain processes necessary for the performance of our service.
We will not share your information with any third parties for the purposes of direct marketing, other than in relation to our own services.
We work with a number of suppliers, including introducers and cloud service providers who process data on our behalf. Some of these providers may be based outside of the UK and we may be required to transfer your information outside of the EEA. We have Data Processing Agreements in place with all third parties which ensures the protection and confidentiality of your data. In such cases all transfer of data is made in accordance with the requirements of Regulations (EU) 2016/679 of GDPR.
By using our service you consent to the transfer of your information outside the EEA as set out above.
Some of our suppliers use their own sub-processors in order to provide their service. In these situations both the supplier and sub-processor become data controllers and are subject to the requirements of GDPR.
4. Your rights
As the data subject you have the following rights:
- The right to be informed about our collection and use of personal data:
- The right to Access Your Personal Information, also known as a ‘Data Subject Access Request’.
- The right to rectification of Your Personal Information
- The right to Stop or Limit Our Processing of Your Data (e.g. for marketing)
- The right to Erasure of your Data
- The right to data Portability and to transfer/obtain your Data in a structured format
- The right to lodge a complaint with the supervisory authority responsible for data protection matters.

5. How long we keep your information for
If you make an enquiry but do not enter into a contract with us, we will keep your personal data for up to three years, during which we will attempt to contact you using the telephone number and/or email address provided in order to follow up on your enquiry. You can opt out at any time by contacting us.
Once you enter into a contract with us, we will keep your personal data for six years following the conclusion of our contract in order to comply with Anti Money Laundering and/or accounting and legal requirements.

We may change this Privacy Notice from time to time.
